DEFINITIONS

Business days – days from Monday to Friday except for public holidays.

Buyer – any entity and person who enters into a Contract in the Store

Product – an item available in the Store which is the subject of the Contract between the Buyer and the Seller

Store – Milk Racing online store operated by the Seller at milkracing.com.

Regulations – these terms and conditions.

Contract – a contract concluded remotely within the meaning of Article 2 item 1 of the Act of May 30 2014, on consumer rights, between the Seller and the Buyer, the subject of which is the Product.

User – a person using the website of the Store milkracing.com .

§ 2

GENERAL INFORMATION

The owner of Milk Racing brand is EV-TECH Sp. z o.o. 

The use of the website milkracing.com and its functions is subject to your agreement to the Terms of Use of the website and functions contained below.

A device with Internet access is required for the proper operation of the Store.

§ 3

CHANGES TO THE TERMS AND CONDITIONS

We reserve the right to change these Terms and Conditions at any time. In the case of changes that directly affect customers, we will notify them by email. Customers have the right to object to the changes made.

§ 4

PRODUCTS

The store provides parts for electric motorcycles. More information about individual products can be found on our website under “SHOP ALL”.

§ 5

PLACING AN ORDER

When placing an order, you must provide your name, billing information, address, email address and phone number. The User is responsible for providing accurate information.

MILK RACING is not responsible for inaccurate or outdated address or contact information and is under no obligation to make an effort to obtain the correct information.

You may update your contact or shipping information before the product is shipped by sending a request through the “Contact Us” tab.

Once the order is placed, an order confirmation will be sent to the email address provided. In case of any difficulties, the User will be informed about them through the provided e-mail address.

MILK RACING has the right to refuse the order if the User fails to comply with the terms of the contract (e.g. failure to make payment on time or in case of incorrect or incomplete data).

§ 6

DELIVERY OF PRODUCTS

We are committed to presenting our products as faithfully as possible. However, it’s crucial to note that the perceived color can be influenced by the settings of your monitor, screen, and the device you’re using. This variance might lead to a slight difference between the color you see on your display and the actual color of the product you receive.

For detailed information, we suggest going through the product descriptions and urge you to reach out to our customer service team should you have any inquiries concerning color specifics. To ensure clarity and accuracy in conveying the colors of our powder-coated products, we utilize the internationally recognized RAL color standards.

MILK RACING will make every effort to deliver the Products as soon as possible. However, the estimated delivery time may be subject to change. The User placing an order is aware of this.

In connection with delays or failure to meet the estimated Product shipment, MILK RACING shall not be liable. Accordingly, it shall not be obliged to incur additional costs or issue discounts or compensation.

Shipping fees are determined on a case-by-case basis, depending on the destination of the order. Orders sent outside the company’s home country may be subject to extra costs related to customs clearance.

Once the Store dispatches the shipment, the User is entitled to track their order. They will receive an individual tracking number specifically assigned to their order.

We are not responsible for delays, lost or damaged shipments caused by courier companies; however, please contact us if you have any problems with your shipment.

The user is required to collect the shipment on the scheduled delivery date. The company bears no responsibility for any extra charges incurred due to the recipient’s absence. Furthermore, the company will not cover any fees charged by courier services for re-sending the package to the recipient for re-delivery.

All MILK RACING products are shipped after prior payment.

RETURN POLICY

Before finalizing your order, please verify the product configuration. Once the order is placed, it will not be possible to make any changes or cancellations of the order. All wheels are custom-assembled according to your order returns and refunds are not applicable for this product.

§ 8

RETURN OF FUNDS

You should expect a refund within four weeks after the package is handed over to the courier company. However, in many cases you will receive a refund sooner. This period includes the transit time for us to receive your refund from the shipper (5 to 10 business days), the time it takes for us to process your refund (3 to 5 business days), and the time for your bank to process our refund (5 to 10 business days).

If you have not received your refund, please recheck your bank account and contact your credit card company, as the funds may take several to post. Next, contact your bank, in which case it may also take several business days for the funds to post. If none of the above actions has been successful, contact us.

OBLIGATIONS OF USERS

We offer our Products to physical consumers, companies and legal entities. By buying our Products as a legal entity, you undertake to have the authorization that ensures the ability to buy on the data of the company represented

USING THE FUNCTIONS OF THE SITE

By using the functions available on the site, you are obliged to comply with applicable laws, regulations and public orders.

By using the site, the User agrees to abide by the rules described in the regulations.

§ 11

PRICES AND PAYMENT

The User must pay all mandatory fees associated with the purchase of Products available on the site. The prices on the site include VAT and all other additional fees and taxes.

The prices of the Products in question may vary depending on the selected accessories, colour versions or combinations. However, the final price is always calculated and updated.

We have the right to change the prices of the Products, and when the change is applied after the User has previously placed an order, the User will not be charged additional costs.

The User has the right to choose payment method that is convenient for him. We offer the possibility to pay by American Express, Discover, Mastercard, VISA, Google Pay, Apple Pay, Amazon Pay, Pay Pal and Klarna, as well as by traditional transfer. All payment methods will be presented to the User at the time of ordering.

The currency in which payment is required shall depend on the place of delivery/residence of the Ordering Party.

Payment in full shall be collected at the time of finalization of the order.

MILK RACING is not responsible for additional fees (e.g. currency conversion or verification fees) charged by banks.

By placing an order and making a payment, the User confirms using funds from a legitimate source. If the User is using a card of which he owns, or if the card has another owner, has authorization from the owner to use it.

If the payment is not authorized or approved, or if there are any problems on the part of the bank, the order may be deleted.

To provide various payment methods, we use external companies. Therefore, users must be aware that they may be asked for additional personal data and all necessary information during the payment process. These data are needed to authorize the payment and process it. The processing of personal data is carried out following the payment provider’s privacy policy

§ 12

CUSTOMS FEES, DUTIES, SURCHARGES AND TAXES

All Milk Racing products are shipped under the terms of DDP (Delivered Duty Paid), according to Incoterms 2010, to buyers within the EU, ensuring that all duties and taxes are covered by us up to the delivery address. For buyers outside the EU, products are delivered DAP (Delivered At Place), where duties and taxes are the buyer’s responsibility upon arrival. We are capable to ship to virtually any address in the world.

Our company is based in the European Union. Orders dispatched to destinations outside our home country could be subject to extra costs or fees due to customs clearance processes. We advise you to familiarize yourself with the customs regulations and laws within your country, as we cannot be held responsible for any additional charges that may arise during customs clearance.

The FedEx company may reach out to you directly. If you have any doubts or require assistance regarding your shipment, please do not hesitate to contact us. We are here to provide support and help you with the process.

WARRANTY

Our Privacy Policy ensures that your personal information is handled with the utmost care and confidentiality. This commitment extends to our products, which are covered by a comprehensive one-year warranty. This warranty guarantees not only the quality and performance of our offerings but also reinforces our dedication to your satisfaction and trust.

§ 14

LOST, STOLEN, DAMAGED AND RETURNING ORDERS

Milk Racing cannot be held liable for packages lost or stolen due to the practices of shipping companies. Packages are usually left at your doorstep without the need for a signature.

Nonetheless, Milk Racing commits to facilitating the process of filing a claim with the shipping company on your behalf, aiming to recuperate the cost of the products lost or stolen during delivery.

If any items in your order arrive damaged, please notify us at once. If the package is being delivered and you notice the damage in the presence of the delivery person, it’s crucial to report it immediately to them. Ensure you keep all original packaging and take photos of the damage for documentation.

Nonetheless, Milk Racing commits to facilitating the process of filing a claim with the shipping company on your behalf, aiming to recuperate the cost of the products lost or stolen during delivery. We handle damage claims through the shipping carriers, FedEx and GLS, on our customers’ behalf. Milk Racing is committed to assisting you through the claims procedure. We appreciate your patience, as sometimes the process may take longer than expected.

It is important to note, however, that we cannot guarantee the shipping company will approve the refund, as they evaluate each case on an individual basis.

If you have any doubts about the claims procedure, we encourage you to us for guidance before proceeding. Should the customer initiate a claim with the shipping company, Milk Racing will not issue refunds, regardless of the result of the claim. If the shipping company approves your claim, they will compensate you directly. Furthermore, once a claim has been filed by the customer, Milk Racing is precluded from submitting an additional claim for the same package.

Please note that if the package is returned to us due to missing documents on your end or failure to pay any additional duties, we are not responsible for the return. You will be obligated to cover all costs associated with returning the package.

DISCLAIMERS

The company reserves the right to amend these terms and conditions for reasons of necessity caused by amendments to the law.

The Products available on our site are described in detail. However, they may differ slightly from the product received. The difference may be, for example, the shade of the Product. This is due lighting used when taking pictures. MILK RACING is not responsible for such discrepancies.

All errors on the site, errors related to payments, operation of the site, product descriptions and photos available on the site may be caused by human factors. If there is any problem with your order, please contact us using the contact form available on the site. We will try to resolve any doubts and solve the problem as soon as possible.

You are responsible for appropriately using the product purchased from our store by its application and following applicable law.
